Terms of Service

These terms are the agreement between you and Whelpy Ltd(“Whelpy”, “we”, “us”), a UK company being incorporated to run Whelpy. Until its incorporation completes, its founder, Dean Gammon, is the party you contract with and carries every obligation in these terms, which transfer to Whelpy Ltd on incorporation (see clause 13). They govern your use of Whelpy, the subscription software at whelpy.co.uk for UK dog breeders (breeding and litter records, the statutory council record book, bookkeeping, the buyer portal and related tools). By creating an account or using Whelpy you accept these terms. If you are agreeing on behalf of a business, you confirm you are authorised to do so.
1. What Whelpy is — and is not
Whelpy is a record-keeping and administration tool. It helps you organise your own information — your dogs, litters, buyers, accounts and documents. It does not provide legal, veterinary, accounting or tax advice, and it does not replace your professional advisers. The templates, prompts, calculations and record formats we provide (including the Schedule 6 record book, HMRC-oriented accounts and any receipt scanning) are aids to help you keep your own records; you remain responsible for meeting your own legal obligations. See clause 12 (Our responsibility to you).
2. Your account
- You must give accurate registration details and keep them up to date.
- You are responsible for keeping your password safe and for everything done under your account, including by staff you invite.
- You must have the legal right to store the information you enter — including buyers’ and third parties’ personal details — and must handle it lawfully. When you enter other people’s personal data, you are the data controller for it and Whelpy processes it for you (see the Privacy Policy). Our Data Processing Terms set out what we may do with that data, our security and breach duties, and the providers we use; they form part of this agreement and are the written processor contract UK data protection law requires between us.
- You must be at least 18 and using Whelpy for a genuine breeding activity.
3. Your content
You keep ownership of the records, photos and documents you upload. You grant us the permission we need to store, process and back up that content solely to run the service for you. You are responsible for the accuracy and legality of what you upload and of any agreements or contracts you make with buyers.
4. Plans and features
Whelpy Lite is free. Whelpy Pro is a paid subscription that unlocks the compliance, accounts and pedigree tools. We may add, change or remove features to improve the service; if a change materially reduces a core Pro feature you rely on, clause 6 (Price and plan changes) and your right to cancel apply. Data export (Excel, CSV and file downloads) is always available on every plan, including Lite.
5. Subscriptions, billing and renewal
Whelpy Pro costs £19.99 per month or £199.99 per year. These prices are the total you pay— nothing is added at checkout. Payments are collected by our payment processor, Stripe; your full card details are entered with Stripe and never reach Whelpy’s systems.
Auto-renewal. A Pro subscription renews automatically at the end of each billing period (monthly or annually) at the then-current price, and the payment method on file is charged, until you cancel. You can cancel at any time from your billing settings in Whelpy, which open the Stripe customer portal — no phone call or email required. Cancelling stops the next renewal; unless you have a right to a refund (see clause 7), your plan stays active until the end of the period you have already paid for, after which it reverts to Lite.
6. Price and plan changes
We may change the subscription price or the make-up of a plan. If we do, we will give you at least 30 days’ notice by email before the change takes effect. Any new price applies only from your next renewal after the notice period — never mid-term on a period you have already paid for. If you do not want to continue at the new price or on the changed plan, you can cancel before it takes effect and it will not be charged.
7. If you are a consumer
Most Whelpy customers are businesses (licensed or commercial breeders). If you are a consumer — an individual not acting for business purposes — you have a 14-day cooling-off period from the day you subscribe to change your mind and cancel Whelpy Pro for a refund.
Because Pro gives you the paid tools immediately, by subscribing you expressly ask us to start providing the service straight away, during the 14-day period, and you acknowledge that if you cancel within those 14 days we may keep a proportionate amount for the part of the month or year you have already had access to. If you have not used Pro at all, you get a full refund.
How to cancel within the 14 days: cancel from your billing settings in Whelpy (they open the Stripe billing portal), or email us at hello@whelpy.co.uksaying you want to cancel — no particular form of words is needed. We will refund as described above, to the payment method you used, without undue delay.
Where the law requires it, after an automatic renewal you will also have a short period to cancel the renewed term and receive a refund; we will tell you how in the renewal reminder email.
8. Founding kennels
Some early kennels were given Whelpy Pro free for the lifetime of the account. If your account has this benefit:
- It lasts for as long as that account remains open — you will not be charged for Pro.
- It is tied to that one account and is non-transferable — it cannot be moved to another account, sold, or passed to a new owner of your business.
- It ends permanently if the account is closed or deleted (by you or by us for a breach of these terms) and does not carry over to any later account.
9. Acceptable use
- Don’t upload unlawful, harmful, misleading or infringing content.
- Don’t try to access other kennels’ or buyers’ data, or probe, scrape or attack the service.
- Don’t misuse the messaging or email features (no spam, harassment or abuse).
- Don’t resell, sublicense or copy the software itself.
10. Your data on exit
You can export your records at any time, on any plan, using the built-in Excel, CSV and file exports — do this before you leave so you keep your own copy. If your subscription lapses or you cancel, nothing is deleted: your account continues on the free plan and your existing records stay readable and exportable; only the paid tools for adding new records are paused.
If you ask us to delete your account (or close it), we delete your personal data promptly on request (subject to anything we must keep by law), and residual copies in our encrypted backups are overwritten within about 30 days as backups rotate. How we handle personal data is set out in the Privacy Policy.
11. Availability
We work hard to keep Whelpy available and to keep your data safe and backed up, but we provide the service on a reasonable-endeavours basis and do not promise a specific uptime or service level. We may occasionally need to pause the service for maintenance, and we will try to keep disruption to a minimum.
12. Our responsibility to you
Your records are your own data, entered and maintained by you. Whelpy is a tool to help you keep them; it is not legal, veterinary, accounting or tax advice, and using it does not transfer your legal responsibilities to us. You remain responsible for your own statutory compliance — including your council animal-activities licence conditions, the Animal Welfare (Licensing of Activities Involving Animals) (England) Regulations 2018 record-keeping duties, and your tax and HMRC obligations. We do not guarantee that a record or calculation in Whelpy will satisfy any particular authority; you should check your own position and take professional advice where needed.
We do not exclude or limit our liability where it would be unlawful to do so — this includes liability for death or personal injury caused by our negligence, for fraud, and (if you are a consumer) your statutory rights that cannot be excluded. Subject to that, and to the fullest extent the law allows:
- we are not liable for loss of profit, loss of business, loss of goodwill, or any indirect or consequential loss;
- we are not liable for loss or corruption of data to the extent you could have avoided it by keeping your own exports/backups as clause 10 describes; and
- our total liability to you for all claims arising in any 12-month period is limited to the total fees you paid us for Whelpy in the 12 months before the claim arose (if you are on a free plan and have paid us nothing, this figure is nil).
13. We may transfer this agreement
We may transfer this agreement, and our rights and obligations under it, to a successor business — in particular from the founder to Whelpy Ltd when its incorporation completes, or in connection with a sale or reorganisation of the Whelpy business. We will give you notice, and any transfer will not reduce your rights under these terms. You may not transfer your agreement to anyone else without our consent.
14. Suspension and termination
You can stop using Whelpy and cancel or delete your account at any time (see clauses 5 and 10). We may suspend or close an account that breaches these terms or that we reasonably believe is being used unlawfully; where it is reasonable to do so, we will warn you first and give you a chance to put things right.
15. Changes to these terms
We may update these terms from time to time. If a change materially affects your rights we will give you reasonable notice by email. The current version and its date are shown at the top of this page.
16. Governing law
These terms and any dispute relating to them are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer living elsewhere in the UK, you keep the benefit of any mandatory protections of your home nation.
